TRADEMARK LIVE EVENT TERMS & CONDITIONS
 
These Event Terms & Conditions (“Event Terms”) form a binding agreement between Trademark Live Ltd (“Promoter”) and any person holding, purchasing, or using a ticket (“you”, “your”) for any Trademark Live-produced event (“Event”).
 
By purchasing a ticket, entering the Event Site, or interacting with the Promoter, you agree to be bound by these Event Terms.
 
These Event Terms incorporate all rules, notices, signage, directives, and instructions issued by the Promoter or Event Staff, whether online, onsite, via social media, or through the Ticket Merchant.
 
1. DEFINITIONS
 
1.1 Promoter means Trademark Ltd and any authorised representative acting on its behalf.
1.2 Event means the Trademark event for which you have purchased or been issued a ticket, including all associated activities, entertainment, performances, and onsite experiences.
1.3 Event Site means the venue or location where the Event is held, including all entry/exit points, surrounding grounds, structures, stages, amenities, and operational zones.
1.4 Event Staff includes the Promoter’s directors, officers, employees, contractors, subcontractors, agents, volunteers, security, bar staff, traffic management, medical personnel, and any Venue personnel.
1.5 Emergency Services Personnel means ambulance staff, medical personnel, police, fire services, and authorised emergency responders.
1.6 Event Terms means these Terms & Conditions and all rules, notices, signage, directives, and instructions issued by the Promoter or Event Staff.
1.7 Ticket Merchant means the authorised ticketing provider used by the Promoter.
1.8 Valid Photo ID means a current NZ driver licence, NZ or foreign passport, or valid Kiwi Access/18+ card.
1.9 Prohibited Items has the meaning given in clause 13.
1.10 Restricted Capacity Areas means any area of the Event Site where capacity limits apply.
1.11 Recorded Materials means any audio, video, or photographic recordings captured at the Event.
1.12 Released Parties has the meaning given in clause 20.
1.13 Force Majeure Event means any event outside the Promoter’s reasonable control, including extreme weather, natural disasters, pandemics, government orders, police actions, venue cancellations, or any similar event.
 
2. UPDATES TO TERMS
 
2.1 The Promoter may update these Event Terms at any time.
2.2 Continued ticket purchase, attendance, or interaction with the Promoter constitutes acceptance of updated terms.
2.3 Updated terms apply immediately upon publication.
 
3. COMPLIANCE WITH LAWS & DIRECTIONS
 
3.1 You must follow all reasonable directions of Event Staff.
3.2 You must comply with all applicable laws, Venue rules, and Event Terms.
3.3 You must comply with any public health orders or communicable disease protocols.
3.4 You must comply with all signage, barriers, fencing, and designated pathways.
3.5 Failure to comply may result in refusal of entry or eviction without refund.
 
4. CONDITIONS OF ENTRY
 
4.1 Entry requires a valid barcoded ticket issued by an authorised Ticket Merchant.
4.2 Tickets are exchanged for wristbands, which must be worn at all times.
4.3 Wristbands that are removed, tampered with, damaged, or defaced are invalid and will not be replaced.
4.4 Entry is conditional upon consent to a search of your person, bags, vehicles, and possessions.
4.5 Searches may include bag checks, pat-downs, metal detection, drug detection, and vehicle inspection.
4.6 Refusal to comply with searches may result in denial of entry or eviction.
4.7 You may be required to present Valid Photo ID at any time.
4.8 The Promoter may deny entry to any person who appears intoxicated, aggressive, unwell, or otherwise unsuitable for entry.
 
5. PROOF OF AGE
 
5.1 18+ Events: Valid Photo ID is required for entry. Persons under 18 will be denied entry.
5.2 All Ages Events: Valid Photo ID is required to purchase alcohol.
5.3 The Promoter may request age verification at any time.
6. TICKETS
 
6.1 You are responsible for ensuring you have purchased the correct ticket type.
6.2 Lost, destroyed, or stolen tickets may be replaced only with proof of purchase.
6.3 Tickets may not be resold at a premium or used for promotions without written consent.
6.4 Ticket limits may be enforced.
6.5 Ticket transfers may be facilitated by the Ticket Merchant; fees may apply.
6.6 Tickets and wristbands are treated like cash. Invalid or tampered tickets will not be replaced.
6.7 Complimentary tickets may not be sold or transferred without written approval.
6.8 Tickets do not guarantee access to all areas of the Event Site.
6.9 Name-on-ticket requirements may apply depending on the Ticket Merchant. You must comply with any ID-matching requirements.

7. RESTRICTED CAPACITY AREAS

7.1 Admission to Restricted Capacity Areas is not guaranteed once capacity is reached.
7.2 No refunds will be issued if access is denied due to capacity limits.
7.3 Attempting to enter restricted areas may result in eviction.
7.4 Restricted areas may include VIP zones, backstage areas, production zones, and any area designated by the Promoter.

8. EVENT PROGRAM, LINE-UP & ENTERTAINMENT CHANGES

8.1 You acknowledge that you are purchasing a ticket to attend the Event, not to see any specific act or attraction.
8.2 The Promoter may change, add, withdraw, substitute, or cancel any artist, performer, attraction, or entertainment element at its discretion.
8.3 Promotional materials are illustrative only.
8.4 You confirm you have not relied on any representation regarding the Event line-up or facilities.
8.5 Except where required by law, no refunds will be provided due to any variation or change.

9. BEHAVIOUR

9.1 Disorderly, unsafe, offensive, violent, discriminatory, or antisocial behaviour may result in eviction.
9.2 You may be evicted for intoxication, drug use, throwing objects, entering restricted areas, climbing structures, damaging property, harassing staff or patrons, presenting symptoms of contagious illness, or any behaviour deemed unsafe.
9.3 Eviction does not entitle you to a refund.
9.4 Illegal behaviour may be reported to police.

10. ALCOHOL, FOOD, DRINK & DRUGS

10.1 The Event is fully licensed. Do not bring alcohol; it will be confiscated.
10.2 Only alcohol purchased onsite may be consumed.
10.3 No food or drink may be brought into the Event Site except empty plastic or stainless-steel bottles (no glass).
10.4 Supplying alcohol to minors will result in eviction and may be referred to police.
10.5 Possession, supply, or consumption of illicit drugs will result in eviction and may be referred to police.
10.6 The Promoter may refuse service of alcohol to any person.

11. SMOKING

11.1 Smoking and vaping are permitted only in designated areas.
11.2 Smoking is prohibited indoors, undercover, or within 4 metres of food service areas.
11.3 Additional non-smoking areas may be designated.


12. PHOTOGRAPHY & RECORDING
12.1 Personal digital cameras and smartphones are permitted.
12.2 Professional photography equipment is prohibited without media accreditation.
12.3 Recording or filming the Event is prohibited unless authorised.
12.4 The Promoter may confiscate and/or delete unauthorised recordings.
12.5 The Promoter may issue takedown notices for unauthorised content.
12.6 Commercial use of Event imagery is prohibited.

13. RECORDING BY PROMOTER

13.1 You consent to being filmed, photographed, or recorded at the Event, including by drones.
13.2 You grant the Promoter a perpetual, royalty-free, worldwide licence to use Recorded Materials for any purpose.
13.3 You waive all moral rights in respect of Recorded Materials.
13.4 Recorded Materials may be used for marketing, advertising, archival, or promotional purposes.

14. PROHIBITED ITEMS

Prohibited Items include but are not limited to:

  • Alcohol

  • Glass

  • Air horns

  • Illegal substances

  • Weapons, tasers, pepper spray

  • Nitrous oxide

  • Projectiles, bats

  • Trading signs

  • Animals (except service dogs)

  • Flares, fireworks, sparklers

  • Instruments

  • Drones

  • BBQs, gas bottles, butane

  • Fires, open flames

  • Flammable liquids

  • Explosives

  • Large sound systems

  • Laser pens

  • Couches, armchairs

  • Studded clothing

  • Audio/video recording devices (except phones)

  • Professional photography equipment

  • Skateboards, scooters, bikes, hoverboards

  • Advanced vapourisers

  • Kites, sky lanterns

  • Toy guns, water guns

  • Tripods, monopods, selfie sticks

  • Unauthorised promotional materials

  • Eskies, coolers

  • Umbrellas

  • Any item deemed dangerous or offensive by Event Staff

Confiscated items will not be returned.

15. MOVEMENT, ACCESSIBILITY & SAFETY

15.1 You must move safely and follow all directional signage.
15.2 Do not obstruct pathways or emergency exits.
15.3 Some areas may not be accessible due to venue limitations.
15.4 Contact the Promoter prior to the Event for accessibility needs.
15.5 Unsafe movement (running, pushing, climbing) may result in eviction.
16. INJURY, ILLNESS & MEDICAL TREATMENT
16.1 The Promoter may arrange medical treatment or emergency evacuation at your cost.
16.2 The Promoter may disclose personal information to emergency services if required.
16.3 You must report symptoms of illness immediately.
16.4 You may be evicted if presenting symptoms of contagious disease.
16.5 The Promoter is not responsible for medical costs.

17. ENVIRONMENT

17.1 Patrons must respect the Event Site and surrounding areas.
17.2 Dispose of waste responsibly and use recycling systems.
17.3 Environmental harm may result in eviction.
17.4 All belongings must be removed at the conclusion of the Event.
17.5 The Promoter may discard, donate, or recycle items left behind.

18. EXCHANGES & RESALE

18.1 Exchanges are discretionary and not guaranteed.
18.2 Exchange credit applies to face value only.
18.3 Fees and addons are non-refundable.
18.4 Resale is facilitated but not guaranteed.
18.5 Resale refunds exclude booking and transaction fees.

19. REFUNDS, CANCELLATION & FORCE MAJEURE

19.1 The Event is an all-weather event.
19.2 No refunds except as required by the Consumer Guarantees Act 1993.
19.3 No refunds for incorrect ticket type, late arrival, early departure, or eviction.
19.4 If the Event is cancelled due to Force Majeure, refunds may be issued less reasonable fees.
19.5 If postponed within 12 months, tickets remain valid and refunds are not required unless mandated by law.
19.6 Force Majeure Events include extreme weather, natural disasters, pandemics, government orders, police actions, venue cancellations, or any event outside the Promoter’s control.

20. RELEASE, INDEMNITY & ASSUMPTION OF RISK

20.1 Entry is at your own risk.
20.2 You accept all risks associated with attendance, including injury, illness, property damage, and economic loss.
20.3 You are responsible for your belongings.
20.4 You waive all legal rights of action against the Released Parties.
20.5 You indemnify the Released Parties for any loss arising from your negligence, breach, or misconduct.
20.6 The Promoter is not liable for theft, loss, or damage to personal property.

21. PRIVACY

21.1 Personal information is collected and handled in accordance with the Promoter’s Privacy Policy.
21.2 Information may be shared with emergency services if required.
21.3 Contact tracing information may be collected if required by law.

22. NOVATION & ASSIGNMENT

22.1 The Promoter may assign or novate its rights and obligations under these Terms.
22.2 Assignment does not affect the validity of these Terms.

23. SEVERABILITY

23.1 If any provision is unenforceable, it shall be severed without affecting the remaining provisions.

24. GOVERNING LAW

24.1 These Terms are governed by New Zealand law.
24.2 You submit to the exclusive jurisdiction of the New Zealand courts.
